2. Purpose of the T&Cs
These T&Cs define the conditions applicable to any order placed on the website www.marielouiseorlach.com by a consumer or non-professional customer.
Any order placed on the website implies the customer’s full and complete acceptance of these T&Cs.
The customer acknowledges having read these T&Cs before confirming their order.
3. Products
The products offered for sale are those presented on the website www.marielouiseorlach.com, subject to availability.
Each product has a description sheet indicating its main characteristics.
Product photographs, visuals, and illustrations are presented with the greatest care. However, slight differences may exist between the visuals displayed on screen and the actual product, particularly due to screen settings, lighting, or color rendering.
Marie-Louise Orlach® reserves the right to modify the range of products offered for sale on the website at any time.
4. Prices
Product prices are indicated in euros, including all taxes, unless otherwise stated.
Delivery fees are indicated separately before final confirmation of the order.
The total price payable by the customer is indicated before order confirmation. It includes the price of the products ordered as well as the applicable delivery fees.
Marie-Louise Orlach® reserves the right to modify its prices at any time. However, the price applicable to an order is the price displayed on the website at the time the customer confirms the order.
5. Order
The customer selects the products they wish to order and adds them to their cart.
Before definitively confirming the order, the customer may check the details of the order, the total price, the applicable delivery fees, and correct any errors.
The order becomes final after payment confirmation.
After confirming the order, the customer receives a confirmation email summarizing the essential information relating to the order.
Marie-Louise Orlach® reserves the right to refuse or cancel any order in the event of an existing dispute with the customer, suspected fraud, an obvious pricing error, product unavailability, or a payment issue.
6. Payment
Payment is made online at the time of ordering, using the payment methods offered on the website.
The available payment methods are indicated to the customer during the order process.
The order will only be processed after effective payment confirmation.
The customer guarantees that they are fully authorized to use the chosen payment method to pay for their order.
7. Delivery
Products are delivered to the address provided by the customer when placing the order.
Deliveries are currently made to mainland France, unless otherwise stated at the time of ordering.
Orders are shipped via Colissimo or international parcel services.
A tracking number is sent to the customer by email when the order is shipped, where this service is available.
Preparation and delivery times are indicated in the Shipping Policy available on the website.
In the absence of a specific delivery timeframe, delivery will take place without undue delay and no later than 30 days from the order date, in accordance with the rules applicable to distance selling.
The customer is responsible for the accuracy of the delivery information provided when placing the order. In the event of an incorrect address, incomplete address, or inability to deliver attributable to the customer, reshipping costs may be charged to the customer.
8. Transfer of Risk
The risk of loss or damage to the products is transferred to the customer when the customer, or a third party designated by them other than the carrier, takes physical possession of the products.

9. Right of Withdrawal
In accordance with Article L221-18 of the French Consumer Code, consumer customers have a period of fourteen days to exercise their right of withdrawal in the context of a distance contract, without having to give any reason.
The withdrawal period begins on the day the product is received by the customer or by a third party designated by them.
To exercise their right of withdrawal, the customer must notify their decision before the expiry of the 14-day period, by means of a clear statement sent by email to:

The customer may use the withdrawal form template provided at the end of these T&Cs, although its use is not mandatory.
10. Product Returns
After notifying their withdrawal, the customer has fourteen days to return the product or products concerned.
Products must be returned complete, unused, undamaged, in their original packaging where possible, and in a condition allowing them to be resold.
Any product returned incomplete, damaged, used, soiled, or deteriorated may not be refunded, or may be subject to a reduction in value if its handling exceeds what is necessary to establish its nature, characteristics, and proper functioning.
Return shipping costs are borne by the customer, except in the event of an error by Marie-Louise Orlach® or a defective product.

11. Refund
In the event of a valid exercise of the right of withdrawal, Marie-Louise Orlach® will refund the customer all sums paid, including the initial standard delivery costs.
Additional costs resulting from the customer’s choice of a delivery method that is more expensive than the standard delivery method offered will not be refunded.
The refund will be made within a maximum period of fourteen days from the date on which Marie-Louise Orlach® is informed of the customer’s decision to withdraw.
However, the refund may be deferred until the returned product has been received or until the customer has provided proof of shipment of the product, whichever occurs first.
The refund will be made using the same payment method as that used for the order, unless the customer expressly agrees to another refund method.
12. Exceptions to the Right of Withdrawal
In accordance with Article L221-28 of the French Consumer Code, certain products may not be subject to the right of withdrawal.
This applies in particular to:
- products made to the customer’s specifications or clearly personalized;
- products unsealed after delivery that cannot be returned for reasons of hygiene or health protection;
- products likely to deteriorate or expire rapidly;
- digital content supplied on an intangible medium where performance has begun with the customer’s prior agreement and express waiver of the right of withdrawal, where applicable.
If an exception applies to a product, this will be indicated on the product page or during the order process.
13. Legal Guarantees
Products sold on the website benefit from the applicable legal guarantees, including:
- the legal guarantee of conformity;
- the guarantee against hidden defects.
The legal guarantee of conformity is mandatory and applies to contracts concluded between a consumer and a professional seller.
In the event of a lack of conformity, the customer may request the repair or replacement of the product, under the conditions provided for by the French Consumer Code. Bringing the product into conformity must be carried out free of charge for the consumer and within a maximum period of 30 days following the request, where the legal conditions are met.
The customer may also act on the basis of the guarantee against hidden defects, under the conditions provided for in Articles 1641 et seq. of the French Civil Code.

14. Product Availability
Products are offered subject to availability.
In the event that a product becomes unavailable after the order has been confirmed, Marie-Louise Orlach® will inform the customer as soon as possible.
The customer may then choose between a refund for the unavailable product or, where possible, a replacement solution proposed by Marie-Louise Orlach®.
15. Liability
Marie-Louise Orlach® shall not be held liable for the non-performance or improper performance of the contract attributable to the customer, to an unforeseeable and unavoidable act of a third party to the contract, or to a case of force majeure.
No provision of these T&Cs limits or excludes the consumer’s legal rights, particularly regarding the right of withdrawal, the legal guarantee of conformity, the guarantee against hidden defects, or the seller’s legal liability.

As part of online sales, Marie-Louise Orlach® may collect and process certain personal data of the customer, particularly for order management, payment, delivery, customer service, and legal obligations.

Any reproduction, representation, modification, distribution, or exploitation, whether total or partial, without prior written authorization from Marie-Louise Orlach®, is prohibited.
18. Consumer Mediation
In accordance with Articles L616-1 and R616-1 of the French Consumer Code, consumer customers have the right to use a consumer mediator free of charge in order to seek an amicable resolution of a dispute with Marie-Louise Orlach®, provided that they have first submitted a written complaint to Marie-Louise Orlach®.
Marie-Louise Orlach® is currently in the process of appointing a consumer mediator referenced by the CECMC.

19. Applicable Law
These T&Cs are governed by French law.
In the event of a dispute, the customer is invited to contact Marie-Louise Orlach® first in order to seek an amicable solution.
Failing an amicable resolution, the dispute may be brought before the competent courts in accordance with ordinary law.
20. Modification of the T&Cs
Marie-Louise Orlach® reserves the right to modify these T&Cs at any time.
The T&Cs applicable to an order are those in force at the time the customer confirms the order.
